By accepting delivery of any product ordered from TOM3C.COM (“www.tom3c.com”), you ("Customer") agree to be bound by the terms and conditions listed below. You and TOM3C.COM agree that the following terms and conditions are the exclusive terms governing the sales transaction between Customer and TOM3C.COM. Any attempt to alter, supplement, modify or amend these terms and conditions by the Customer will be considered a material alteration of this agreement and, therefore, are null and void. In addition, these terms and conditions are subject to change at any time, without prior written notice. Therefore, please check these terms and conditions carefully each time you place an order with or accept delivery of any goods from TOM3C.COM.
An order is not binding upon TOM3C.COM until it is accepted; TOM3C.COM must receive payment before it will accept an order. Payment for products ordered is due prior to shipment. Customer can make payment by bank transfer, or some other method prearranged with TOM3C.COM. You agree to pay the amounts due as specified on the invoice, and you agree to pay interest on all past-due sums at a rate of 3% per month or the highest rate allowed by law, whichever is greater.

Total Time For Delivery
TOM3C.COM will try to deliver all the items to the customer as soon as possible. However, total time is based on the amount of time it takes to get payment authorization, order processing, handling, and the delivery time from the carrier. This can range from 1 to 3 working days (in Malaysia), or certain items and location may takes longer time to deliver.
All order make on weekends will be process on next Monday.
All order make on holiday will be process on next working day.
Processing time start from the day payment are successfully transferred to our bank.
Delivery time start from the day the items are shipped.
Your total cost for purchase of any product will include the shipping and handling charges shown on your invoice. However, your original shipping fees are non-refundable in the case of a returned product. Those fees are paid for the services provided by and to the original carrier, and will not be refunded to you if your item is returned for a refund to TOM3C.COM.
Note: Please be informed the shipping and handling charges will not include the custom duty tax by your local government custom office. Carrier may charge for Remote Area Service fees for some location, customer will be inform to make payment for the Remote Area Service fees before the goods is shipping out. Or else, customers can imform us to cancel the order and get refund.
Risk Of Loss
All items purchased from TOM3C.COM are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. All package sent are sealed with TOM3C.COM label on the package, if you believe the seal or package are broken when the items arrive to your door step, you can refuse to receive it and Contact Us for assistance.
Exchange & Return Policy
All products sold from TOM3C.COM are not refundable unless the product offered by TOM3C.COM are “Not as Described”. Most products are shipped with a return & exchange guarantee period unless otherwise noted in the product listing. However, the return & exchange guarantee period is not a trial or testing period. All used products cannot be return for exchange. All products sold with wrong order placed by customers own mistake cannot return for exchange. All products (unless otherwise indicated) must be return within 30 days from the "Date of Purchase" for exchange. The "Exchange & Return Policy" only applies to manufacturing defects, which occur under the conditions of normal and proper using, it does not cover defects arising from misuse, improper care or maintenance. All returned products must be in full package. These terms apply to all returns. Customers must submit a RMA request by visiting our Returns section and we will investigate and resolve the situation accordingly. TOM3C.COM will return any products which has defects arising from misuse, improper care or maintenance, and any package returned with missing items back to the customer at the customer's expense.
Physical Damage Policy
Physical damage to any product purchased at TOM3C.COM will effectively void warranty coverage. Physical damage product cannot be returned for warranty claim. Physical damage includes improper handling or any other type of damage sustained by irregular usage. TOM3C.COM will return any physically damaged product back to the customer at the customer's expense.
TOM3C.COM attempts to be as accurate as possible. However, TOM3C.COM does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by TOM3C.COM is "Not as Described", your sole remedy is to return it in full package and unused condition.
Product “Not as Described”
An item is “Not as Described” if it is materially different than what it was described in the product listing. Below are some examples:
You received a completely different item. Example: You purchased a motherboard and received a keyboard.
The item was advertised as original but is not original.
The item is missing major parts or features which were not disclosed in the listing.
You purchased three items but only received two.
An item is not “Not as Described” if it is materially similar to the product listing description. Below are some examples:
The item was properly described but you didn't want it after you received it.
The item was properly described but did not meet your expectation.
The item was properly described as what the manufacturer described but the performance or quality did not meet your imagination.
Warranties; All Product Sold "As-Is" Or "With All Faults"
TOM3C.COM is a reseller only. Products sold by TOM3C.COM are not manufactured by TOM3C.COM. The products may, however, be covered by each manufacturer's warranty, service, and support policy (if present). TOM3C.COM assigns and passes through to the customer any warranty of the manufacturer, and customer acknowledges that it shall have recourse only under such warranties and only as against the manufacturer of the products. TOM3C.COM makes no representation or express warranty with respect to the product except those stated in this document. TOM3C.COM disclaims all other warranties, express or implied, as to any such product, including and without limitation, the implied warranties of merchantability and fitness for a particular purpose, and any implied warranties arising from statute, trade usage, course of dealing, or course of performance.
All items sold through TOM3C.COM are sold "as-is" or "with all faults." the entire risk as to the quality and performance of these items is with the buyer. Should any of these items prove defective, do not function, or function improperly in any way following their purchase, the buyer, and not the manufacturer, distributor, or TOM3C.COM, assumes the entire cost of all necessary servicing or repair.
These terms and conditions, together with TOM3C.COM invoice regarding the products ordered by Customer, are the complete and exclusive agreement between TOM3C.COM and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between TOM3C.COM and Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.
